What is Section 69 BNS (BNS 69)?

In India, Section 69 of the Bharatiya Nyaya Sanhita (BNS) plays a crucial role in safeguarding individuals from deceitful practices in relationships. This law specifically addresses situations where someone uses false promises or deceptive tactics to engage in sexual intercourse without any genuine intention of fulfilling those promises.

Section 69 BNS targets instances where sexual activity is obtained through deceitful means. This could involve various forms of deception, such as:

  • False Promise of Marriage: This may include making a false promise of marriage to someone in exchange for sexual favors.
  • Inducement with False Job Offers: Another scenario covered under this section is when someone uses fake job opportunities or promotions to manipulate someone into a sexual relationship.
  • Hiding True Identity: This includes cases where individuals hide important details, like their marital status or background, to deceive someone into a sexual relationship.

Support for Victims of Section 69 BNS (BNS 69)

It’s crucial for victims to know that they are not alone. There are several avenues for support and assistance:

  • National Commission for Women (NCW): This organization provides support and legal assistance to women who have been victims of such deceptive practices.
  • State Women’s Commissions: Each state in India has its own commission dedicated to addressing issues faced by women, including those related to deceitful relationships.
  • Legal Help: Seeking advice from a Advocate. Advocate can provide legal advice and representation to victims of sexual assault.
  • NGOs and civil society organizations: There are a number of NGOs and civil society organizations that provide support and assistance to victims of sexual assault.

What is Punishment of BNS 69?

Violating Section 69 BNS (BNS 69) could result in serious consequences, including imprisonment for up to ten years and a fine. This law is crucial as it empowers women who are victims of sexual harassment under false promises to seek justice.

Is Section 69 BNS Bailable or Non-Bailable?

Offense under Section 69 (BNS 69) of the Bharatiya Nyaya Sanhita is a serious matter. Because of this seriousness, the law considers it a non-bailable offense. This means that a person accused under this section does not automatically get bail. Instead, they’ll need to convince a judge to grant them bail during a court hearing.

Is BNS Section 67 cognizable or not?

Yes, offenses under Section BNS 69 (BNS 69) are considered “cognizable.” This means the police have the power to arrest someone accused of violating this section even without a warrant. Police can also start investigating the case right away, without needing a court order first. This allows Police to take immediate action if they witness the crime happening or receive a complaint.

Is BNS Section 69 compoundable or not?

Section 69 BNS (BNS 69) are considered “non-compoundable.” This means that even if the woman filing the complaint (the victim) has a change of heart or mind and wants to withdraw the charges, she usually cannot do so. Once the case is registered and the legal process starts, it’s up to the court system, or “prosecution,” to decide how to proceed, not the victim alone.
